On April 19, 2019, within the framework of the meeting of the Republican tripartite commission on social partnership and regulation of social and labor relations, four issues were considered:
state of labor relations in the regions (map of labor risks, wage arrears, safety and labor protection);
work of sectorial and regional commissions on social partnership and regulation of social and labor relations (mining and metallurgical industry);
work carried out by the national associations of workers to protect the labor rights of workers;
implementation of the Road map on the recommendations of the International labor organization (ILO) on the application of Convention No. 87.
Following the meeting, the local executive bodies are recommended to monitor the situation at the enterprises on a regular basis and to facilitate the consideration of issues raised by employees in the framework of negotiations with the hearing of heads at the meetings of the regional tripartite commissions.
Draft Law of RK "On amendments and additions to some legislative acts of the Republic of Kazakhstan on labor issues" provides for strengthening the protection of workers' rights:
- establishment of the obligation and responsibility of employers to create equal (same) sanitary conditions for employees in order to prevent discrimination while ensuring decent labor conditions;
- consolidation of measures for the implementation of occupational safety management system based on the assessment and management of occupational risks in enterprises;
- introduction of electronic employment contracts and electronic data transmission mechanism on the declaration of the employer's activities to comply with the labor rights of employees, as well as to provide the results of certification of production facilities on labor conditions, etc.;
- elimination of the mandatory vertical structure of trade unions and simplifying the registration process to implement the recommendation of the International labor organization.
Draft law was approved at a meeting of the Government of RK on July 23, 2019.
Due to the importance of the measures taken in the draft Law, it is planned to be adopted before the end of this year.
In order to prevent violations of the labor law, state labor inspectors in 2019 held on 4 751 inspections, including the organizations, attracting of foreign labor force, which identified 6 927 violations.
For all violations 2820 prescriptions were issued to employers
and 1451 administrative fines in the amount of 186.5 million KZT were imposed.
Since the beginning of 2019, state labor inspectors have protected the rights of more than 25 thousand employees, who were paid more than 3.5 billion KZT of wage arrears.
In the first half of this year, state labor inspectors held 914 seminars and classes, and organized more than 400 speeches in the media to explain the norms of labor legislation.
Training center of the Federation of trade unions of the Republic of Kazakhstan is actively working. During the reporting period, 64 training seminars were held with the participation of 1621 people.
Also, taking into account the existing risks in the field of safety and labor protection, on June 26, 2019, the Government approved a Comprehensive road map for reducing occupational injuries and workplaces with harmful labor conditions for 2019-2023, which provides for the introduction of a modern occupational safety management system based on prevention, detection, assessment and management of professional risks, improving the efficiency of state, internal and public control over compliance with labor legislation at the country's production enterprises.
