Is it possible to establish wage size for the worker less than the established minimum wage?

According to article 104 of the Labour code of the RK (hereinafter-the Code), the minimum monthly wage established annually for the relevant financial year by the law of the Republic of Kazakhstan on the republican budget shall not be lower than the subsistence minimum and shall not include surcharges and allowances, compensation and social payments, bonuses and other incentive payments and shall be paid in proportion to the time worked.

At the same time, according to paragraph 3 of article 104 of the Code, the minimum monthly wage or the amount of the monthly tariff rate of the employee of the first category, provided for by the terms of employment, collective agreements and (or) acts of the employer, may not be lower than the minimum monthly wage established for the relevant financial year by the law of the Republic of Kazakhstan on the republic budget.

Thus, the amount of remuneration of the employee cannot be established lower the minimum monthly wage and does not include surcharges and allowances. 

At the same time, the wage is paid for actually worked time with all due surcharges and allowances.
