Today at the plenary session of the Senate of Parliament of Kazakhstan the deputies passed the Law of Kazakhstan "On ratification of the Protocol on amendments and additions to the Agreement on mutual recognition of privileges and guarantees to participants and invalids of the great Patriotic war, participants of combat actions on the territory of other States, families of the lost military personnel from April 15, 1994."
The above Agreement was signed by the heads of governments of the CIS States on 15 April 1994. Since its in the CIS countries there have been dramatic changes in socio-economic sphere, formed of national legislation, developed specific models of social policy. In this case, the document was never amended.
In this regard, at the meeting of the Council of heads of governments of States-participants of the CIS 30 Oct 2015 in Dushanbe signed a Protocol on amendments and additions to the Agreement, which provides:
First, the equal right of citizens in receiving in-kind benefits or cash payments regardless of their place of residence in accordance with national legislation.
Secondly, clarification of the list of guarantees for veterans temporarily residing in the territory of the States Agreement. They have the right to:
- free get emergency medical support in medical institutions in accordance with the laws of the state of stay in diseases, accidents, traumas, poisonings;
- the queue to be served by enterprises and organizations in domestic services, trade, public catering, public transport, housing and communal services, establishments of communication, cultural and educational institutions in accordance with the laws of the state of temporary stay or temporary residence.
Thirdly, the Protocol provides for the expansion of categories of persons covered by the Agreement, and the inclusion of categories of citizens directly involved in combat operations to eliminate illegal armed formations and groups (gangs) in the territories of the Ukrainian SSR, the Byelorussian SSR, Lithuanian SSR, Latvian SSR, Estonian SSR during the period from 1 January 1944 to 31 December 1951.
According to police Kazakhstan has a population of 29 people belonging to this category. They all get special government benefits as participants of the great Patriotic war are provided for them social guarantees.
Fourth, in order a unified approach to the definition of categories of citizens of the former Soviet Union among those taking part in the hostilities Agreement are proposed to Supplement the List of States, cities, territories and periods of warfare with participation of citizens of the former Soviet Union.
Overall, the ratification of the Protocol will effectively implement the rights of citizens to social guarantees and privileges set forth in the Agreement.
