 Article 68 of the Labor Code of the Republic of Kazakhstan of November 23, 2015 (hereinafter - the Code) stipulates that the normal working time should not exceed 40 hours per week.

The employment contract may provide for shorter working hours with payment for both normal working hours.

The Code also provides for the establishment of shorter working hours for certain categories of employees:

for workers between the ages of fourteen and sixteen years - no more than 24 hours per week (Article 69 of the Code);

for workers between the ages of sixteen and eighteen, no more than 36 hours per week (Article 69 of the Code);

for workers engaged in heavy work, work with harmful and (or) dangerous working conditions - no more than 36 hours per week according to the List of industries, shops, professions and positions, the list of heavy work, work with harmful and (or) dangerous working conditions ( Article 69 of the Code);

for disabled workers of the first and second groups - no more than 36 hours per week (Article 69 of the Code).

In accordance with Article 79 of the Code, the organizations should take into account the working time actually worked by the employee.

With a five-day working week, the duration of daily work (shift work) cannot exceed 8 hours at a weekly rate of 40 hours, 7 hours 12 minutes at a weekly rate of 36 hours; with a six-day working week, the duration of daily work (shift work) cannot exceed: for workers with a weekly working time of 40 hours - 7 hours; at a weekly rate of 36 hours - 6 hours, etc.

In this regard, the length of working time is:

With a 40-hour workweek:

at a five-day working week - five working days for 8 hours;

with a six-day working week - five working days for 7 hours and one working day lasting 5 hours.

With a 36-hour workweek:

with a five-day working week - five working days for 7 hours and 12 minutes (7.20 hours);

with a six-day work week - six working days for 6 hours.

In accordance with the Law of the Republic of Kazakhstan of December 13, 2001, No. 267 "On Holidays in the Republic of Kazakhstan" (hereinafter-the Law), the days in which national and state holidays are celebrated in the Republic of Kazakhstan are recognized as holidays in accordance with the labor legislation of the Republic of Kazakhstan.

Holidays in the Republic of Kazakhstan are non-working days.

If the weekend and holidays coincide, the day off is the next working day after the holiday.

Holidays celebrated in the Republic of Kazakhstan:

National holiday:

Independence Day - December 16 - 17;

public holidays:

New Year's Day - January 1-2;

International Women's Day - March 8;

Nauryz meiramy - March 21-23;

The holiday of unity of the people of Kazakhstan - May 1;

Defender of the Fatherland Day - May 7;

Victory Day - May 9;

Capital Day - July 6;

Constitution Day of the Republic of Kazakhstan - August 30;

Day of the First President of the Republic of Kazakhstan - December 1.

In connection with this, when compiling a balance of working hours in 2018, taking into account the norms of the Law, holidays coinciding with weekends (Saturday, Sunday) are transferred to the following working day after the holiday:

at five days' stay:

from December 1 to December 3;

from December 16 to December 18.

at the six-day event:

from December 16 to December 18.

In accordance with Article 84 of the Code, with a five-day and six-day working week, a general public holiday is Sunday.

The second day off for a five-day workweek is established by a collective agreement or labor rules.

The first day of Kurban-ait, celebrated on the Muslim calendar, January 7 - Orthodox Christmas are the days off.

In 2018, the first day of Kurban-ait falls on August 21.

The production calendar shows the norm of working hours for months, quarters and 2018 as a whole in working days (hours). It is calculated according to the calendar of a five-day and six-day workweek, based on an eight-, seven- and six-hour working day with a 40-hour and 36-hour workweek.

In 2018 the norm of working hours is:

with a 40-hour workweek:

five-day - 1968 hours (246 days * 8.00 hours);

six-day period - 1984 hours (247 days * 7.00 hours + 51 days * 5.00 hours);

with a 36-hour workweek:

five-day event - 1771.2 hours (246 days * 7.20 hours);

six-day event - 1788 hours (298 days * 6.00 hours).

The average monthly number of working days for 2018 is:

with a five-day working week - 20.50 days;

with a six-day work week - 24.83 days.

The average monthly number of calendar days for 2017 is 29.25 (excluding holidays fixed by the legislation of the Republic of Kazakhstan).
